Changes proposed to poison centre notifications – draft regulations for amendments to Annex VIII and Article 25 of CLP now published

As of 12 May 2020, the European Commission has proposed new amendments to Annex VIII of CLP (Annex VIII of Regulation (EC) 1272/2008) regarding emergency health response and bespoke paints. This is the second amendment to Annex VIII of CLP, otherwise known as poison centres. Industry stakeholders are invited to add comments to both drafts until 11 July 2020.


Amendment to Annex VIII to address concerns with workability issues in regard to emergency health response

EU Member States and industry stakeholders raised concerns, notably around: 

  • The difficulty or impossibility of knowing the exact composition of products in cases where raw materials with highly variable or unknown composition are used.
  • Where multiple suppliers are being used for components that are stored in the same recipient or where complex supply chains are involved.
  • The impossibility to know in advance which exact bespoke mixtures will be placed on the market.

Amendment to Article 25 of CLP as regards bespoke paints

There is a proposal to add a paragraph (8) to Article 25 of CLP in order to solve the workability issue on bespoke paints. The proposed act constitutes only part of the solution, namely the consequence for the labelling obligations in Article 25 of Regulation (EC) 1272/2008 of the non-necessity to create a UFI for bespoke paints.

ECHA publishes guidance on harmonised information relating to emergency health response 

Additionally, the European Chemicals Agency (ECHA) has also published the ‘Guidance on harmonised information relating to emergency health response – Annex VIII to CLP’ version 3.0. This document provides detailed guidance on the obligation to submit relevant information on hazardous mixtures placed on the market for formulating preventative and curative measures in case of accidents to responsible bodies of the appropriate Member States. This document has been updated with the first set of amendments to Annex VIII of CLP.
