EU CLP Annex VIII adopted in Great Britain

The UK Health and Safety Executive (HSE) have confirmed that EU Annex VIII to the Classification, Labelling and Packaging (CLP) of Substances and Mixtures Regulation (EC No 1272/2008) was inadvertently retained in GB CLP following Brexit. 

HSE has confirmed that they will look at any enforcement decisions on a case-by-case basis. They will consider the efforts made by duty holders to achieve compliance as well as the level of risk when making enforcement decisions. To demonstrate that our clients make the very best effort to achieve compliance, NCEC continues to complete harmonised notifications to the UK authorities on their behalf.

The UK Government is considering a public consultation regarding the Annex, which is expected to last 12 weeks. No date for the start of this consultation has been announced at present. We will remain in contact with the authorities for any further updates.

How does this impact organisations placing mixtures on the market in GB?

  • If you have already made Annex VIII notifications to the GB, you are compliant.
  • If you have completed voluntary notifications in GB, you might need to make Annex VIII notifications. The HSE will consider your efforts to achieve compliance when making enforcement decisions.   • The requirements in Northern Ireland (NI) are not impacted by this change, and Annex VIII continues to be mandatory.
