Final Annex VIII to CLP published

The National Chemical Emergency Centre (NCEC) has learned that the European Commission has today published the long awaited piece of legislation relating to poison centres.

COMMISSION REGULATION (EU) 2017/542 of 22nd March 2017 amending Regulation (EC) No 1272/2008 of the European Parliament and of the Council on classification, labelling and packaging of substances and mixtures by adding Annex VIII on harmonised information relating to emergency health response has been published and can be accessed here.

The amending regulation adds the paragraph ‘Where under Annex VIII the submitter creates a Unique Formula Identifier, it shall be included on the label in accordance with the provisions of section 5 of Part A of that Annex' to Article 25 of CLP and states that the remainder of the requirements are set out in Annex VIII of CLP.

Regulation 2017 / 542 enters into force on the 12th April 2017 and applies from 1st January 2020.

Annex VIII of CLP aims to harmonise the information requirements and notification format for poison centre notifications. As the text currently stands notifications would still need to be provided to each Member State in turn, each with their own processes and individual fee structure.

Whilst this amendment does not apply until 2020, notification is currently a legal requirement in the vast majority of Member States. NCEC has recently seen a number of notices for not meeting the current regulations and has also seen an increase in the enforcement for using the correct numbers in section 1.4 of the SDS over the last three months.
