Like everyone else, we at the National Chemical Emergency Centre (NCEC) have been debating the potential implications of Brexit and what will happen if or when we have a deal with the European Union. Therefore, we thought it would be a good idea to publish the questions we are frequently asked by businesses that are based in the UK with poison centre notifications. The answers provided are based on the best of our knowledge as at 22 March 2019 (9:00am GMT).
The legal requirements regarding poison centres in Member States are laid down in two EU regulations:
- European Regulation (EC) No 1272/2008 – on classification, labelling and packaging of substances and mixtures (CLP).
- European Regulation (EC) No 1907/2006 – concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH).
These put a burden on companies placing hazardous mixtures on the market in Europe.
Frequently asked questions (FAQs) about how Brexit may affect poison centre notifications
Will our poison centre notifications still be valid if we have a no-deal Brexit scenario?
Yes. As far as we know. You do not have to be based in a European country to be placing products on the market within Europe, but you may need to have a European legal entity. However, all mixtures and products should be notified to the poison centres of the Member State where they will be placed on the market.
Do I have to update my notifications?
No. The notifications are valid as long as you are not changing the formulation or the responsible person placing the product on the market. Your notifications will remain valid until 2025. However, this really depends on whether we get a deal or not.
Should I use our European legal entity address as our contact address after Brexit?
No. You don’t have to change your legal entity that is placing the product on the market for poison centre notifications. However, if your company decides for other reasons to change your legal entity working in Europe, please contact us and we can advise you if your notifications are still current.
